Welcome to the Flex Powersports website (the "Site"), operated by Flex Powersports ("Flex Powersports," "we," "us," or "our"), based in Houston, Texas. These Terms and Conditions ("Terms") govern your access to and use of the Site, including any content, functionality, and services offered on or through it. Please read these Terms carefully before using the Site.

1. Acceptance of Terms

By accessing, browsing, or using the Site in any way — including submitting a contact, financing, or quote request form — you accept and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Site. You must be at least 18 years old, and have the legal capacity to enter into a binding contract, to use the Site or submit any form on it.

2. Changes to These Terms

We may revise these Terms from time to time at our sole discretion. The "Last updated" date at the top of this page reflects the date of the most recent revision. Changes take effect as soon as they are posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms, so please check this page periodically.

3. Changes to the Site

We may update, modify, suspend, or discontinue the Site, or any part of it, at any time and without notice or liability. We are not obligated to maintain any particular content, feature, or functionality.

4. Product Information, Pricing & Availability

We make reasonable efforts to display accurate specifications, images, pricing, and availability for the REV M2 and any other vehicles, parts, or accessories referenced on the Site. However:

• Specifications, features, colors, options, dimensions, weights, and range figures are manufacturer-supplied estimates and may vary by unit, configuration, driving conditions, load, and battery age or state of charge.
• Photographs and renderings are representative and may not reflect the exact unit, color, trim, or accessories available at the time of your order.
• Pricing, MSRP, incentives, and availability are subject to change without notice, and we reserve the right to correct pricing or typographical errors at any time, including after an order has been submitted, in which case we will contact you before proceeding.
• Nothing on the Site constitutes a binding offer to sell at a stated price; all orders are subject to our acceptance.

5. Orders, Deposits & Payment

Submitting an inquiry, quote request, or deposit through the Site is a request to purchase, not a guaranteed sale. All orders are subject to credit approval (where financing is involved), vehicle availability, and our acceptance. Prices displayed on the Site do not include applicable sales tax, title, registration, documentation, or delivery/shipping fees unless expressly stated otherwise. Specific deposit amounts, cancellation windows, and refund terms for a given order will be confirmed in writing (e.g., an invoice, order confirmation, or purchase agreement) at the time of sale, and those written terms will govern over any general statement on the Site in the event of a conflict.

6. Street Legality & Regulatory Compliance

The REV M2 is marketed as a low-speed vehicle (LSV) / golf cart. Street legality, permitted use on public roads, registration, titling, insurance requirements, and equipment requirements (such as lighting, seat belts, or windshields) vary significantly by state, county, city, and municipality, and can change over time. It is solely your responsibility, as the buyer or prospective buyer, to research and confirm all applicable legal requirements in your jurisdiction before purchasing, registering, or operating any vehicle referenced on this Site. Flex Powersports makes no representation or warranty, express or implied, that any vehicle is street legal, road-legal, or compliant with the laws of your specific location.

7. Financing

Any financing offers, rates, terms, or "as low as" figures referenced on the Site (including references to Synchrony Financial, Dealer Direct, or other lenders) are provided by independent third-party lenders, not by Flex Powersports. We do not guarantee approval, specific rates, terms, or credit limits. Applying for financing through a link on this Site directs you to that lender's own application, which is governed by the lender's own terms, conditions, and privacy policy — we encourage you to review those before applying. Any financing agreement you enter into is solely between you and the lender.

8. Text Messaging (SMS) Program

By checking the SMS opt-in box on our contact form, or otherwise providing your mobile number and affirmatively agreeing to receive texts, you consent to receive recurring automated text messages from Flex Powersports ("Program") at the mobile number you provide. This consent is not required as a condition of any purchase or financing approval.

Types of messages. The Program may send messages related to: responses to inquiries about the REV M2, financing, or shipping; requested quotes and follow-up on an order or financing application; delivery and appointment scheduling or updates; and general customer care related to your inquiry or purchase. Messages may be sent using an automatic telephone dialing system or similar technology.

Message frequency & cost. Message frequency varies depending on your interactions with us. Message and data rates may apply, as determined by your mobile carrier and plan. Flex Powersports does not charge for text messages sent through the Program.

Opt-out. You may opt out of the Program at any time by replying STOP to any message you receive from us. After you reply STOP, we will send a one-time confirmation that you have been unsubscribed, and you will receive no further messages from the Program unless you opt in again (for example, by resubmitting a form with the SMS checkbox selected).

Help. For help at any time, reply HELP to any message from us, or contact us directly at (855) 234-5551.

Supported carriers. The Program is supported on major U.S. wireless carriers, including AT&T, T-Mobile, and Verizon Wireless, among others. Carriers are not liable for delayed or undelivered messages. Coverage, timeliness, and reliability of message delivery are not guaranteed and may vary by carrier, device, and location.

No sharing for third-party marketing. We do not sell, rent, or share your mobile phone number or SMS opt-in consent with third parties or affiliates for their own marketing or promotional purposes. See our Privacy Policy for more detail on how your information is used and shared.

You are responsible for notifying us of any change to your mobile number. If you cancel your mobile number and fail to notify us, you agree to indemnify Flex Powersports for any costs or liability resulting from messages sent to the new user of that number, to the extent permitted by law.

9. Shipping & Delivery

Where nationwide shipping is arranged, vehicles are transported by independent third-party freight and transport carriers, not operated by Flex Powersports. Delivery timelines, routes, and costs referenced on the Site or quoted to you are good-faith estimates only and may change due to carrier availability, weather, road conditions, mechanical issues, or other factors outside our control. Unless otherwise stated in your written order confirmation, risk of loss transfers in accordance with the terms provided to you at the time of sale. Please inspect your vehicle promptly upon delivery and report any shipping damage to us and the carrier as soon as possible.

10. Warranty Disclaimer

Except for any written manufacturer's or dealer's warranty expressly provided to you in connection with your purchase, the Site and the vehicles, products, and information described on it are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Intellectual Property

All text, graphics, photographs, logos, icons, button designs, video, and other content appearing on the Site (collectively, "Content"), and the compilation and arrangement thereof, are the property of Flex Powersports or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. "Flex Powersports" and associated logos are trademarks of Flex Powersports. You may view and print Content for your own personal, non-commercial use in connection with evaluating a purchase, but you may not otherwise copy, reproduce, republish, distribute, modify, or create derivative works from any Content without our prior written consent.

12. Acceptable Use

You agree not to: (a) use the Site for any unlawful purpose or in violation of these Terms; (b) attempt to gain unauthorized access to the Site, its servers, or any connected systems; (c) interfere with or disrupt the Site's operation, including through malware, excessive automated requests, or scraping; (d) submit false, misleading, or fraudulent information through any form on the Site; or (e) use any part of the Site to compile a database or directory for a competing business.

13. Third-Party Links & Services

The Site contains links to third-party websites and services, including financing partner application portals, shipping partners, and social media platforms. These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content, accuracy, terms, or privacy practices of any third-party site, and your use of any third-party site is at your own risk and subject to that site's own terms.

14. Disclaimer of Warranties (Site Use)

To the fullest extent permitted by law, Flex Powersports disclaims all warranties, express or implied, regarding the operation of the Site and the accuracy, completeness, reliability, or timeliness of any Content, including third-party content or user-submitted information. Your use of the Site is at your sole risk.

15. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Flex Powersports, its owners, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Site, any vehicle purchased through or referenced on the Site, or these Terms, even if advised of the possibility of such damages. To the extent any liability is not excludable under applicable law, our total aggregate liability arising out of or relating to the Site will not exceed the amount you paid to Flex Powersports, if any, in the twelve (12) months preceding the event giving rise to the claim.

16. Indemnification

You agree to defend, indemnify, and hold harmless Flex Powersports and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any applicable law or third-party right.

17. Governing Law & Dispute Resolution

These Terms, and any dispute arising out of or related to them or the Site, are governed by the laws of the State of Texas, without regard to its conflict-of-law principles, and without regard to the United Nations Convention on Contracts for the International Sale of Goods. Subject to the arbitration provision below, you agree that any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.

18. Informal Resolution & Arbitration

Before filing a claim against Flex Powersports, you agree to first contact us at (855) 234-5551 or through our contact form and attempt to resolve the dispute informally for at least 30 days. If we are unable to resolve a dispute informally, you and Flex Powersports agree that any remaining dispute will be resolved by binding individual arbitration under the rules of a mutually agreed arbitration provider, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. This arbitration agreement does not apply where prohibited by applicable law.

19. Class Action Waiver

To the fullest extent permitted by law, any dispute resolution proceeding, whether in arbitration or court, will be conducted only on an individual basis and not as a class, consolidated, or representative action. You and Flex Powersports each waive any right to participate in a class action or class-wide arbitration.

20. Force Majeure

Flex Powersports will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, labor disputes, supply chain disruptions, carrier delays, or governmental action.

21. Severability & Waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

22. Entire Agreement

These Terms, together with our Privacy Policy and any written order confirmation or purchase agreement provided to you, constitute the entire agreement between you and Flex Powersports regarding the Site and supersede any prior agreements regarding the Site.
