Privacy Policy
Last updated: August 20, 2026
This Privacy Policy explains how Flex Powersports ("Flex Powersports," "we," "us," or "our"), based in Houston, Texas, collects, uses, discloses, and protects information when you visit flex-powersports.com (the "Site"), contact us, or apply for financing through a link on the Site. By using the Site, you agree to the collection and use of information in accordance with this policy.
1. Information We Collect
We collect information in the following ways:
- Information you provide directly: your name, email address, phone number, mailing address, vehicle or financing interests, and the content of any message you submit through our contact, quote, or financing-referral forms, or share with us by phone or text.
- Automatically collected information: IP address, approximate location, browser type and version, device type, operating system, pages visited, time spent on pages, referring/exit pages, and similar usage data, collected through cookies, log files, and similar technologies.
- Information from third parties: if you apply for financing through Synchrony Financial, Dealer Direct, or another lending partner linked from our Site, that lender may share limited information back with us (such as confirmation that you applied) in accordance with their own privacy policy.
2. How We Use Your Information
We use the information we collect to:
- Respond to your inquiries about the REV M2, financing, shipping, or other questions;
- Provide requested quotes, follow up on inquiries, and communicate with you by phone, text, or email;
- Refer you to our financing partners when you choose to apply through them;
- Operate, maintain, and improve the Site, and understand how visitors use it;
- Detect, investigate, and prevent fraudulent transactions and other illegal activity, and protect the rights and safety of Flex Powersports and others;
- Comply with applicable legal obligations and enforce our Terms and Conditions.
We do not use your information to make automated decisions that produce legal or similarly significant effects concerning you.
3. Cookies & Tracking Technologies
The Site may use cookies and similar technologies (such as pixels or local storage) for purposes including:
- Essential functionality — enabling core features of the Site to work correctly.
- Analytics — understanding aggregate visitor behavior (for example, via Google Analytics or a similar service) so we can improve the Site.
Most browsers let you refuse or delete cookies through their settings. Doing so may affect some Site functionality. We do not currently respond to "Do Not Track" browser signals because there is no common industry standard for how to interpret them.
4. Text Messages (SMS)
If you check the box to opt in to text messages from Flex Powersports, you consent to receive recurring automated text messages from us at the mobile number you provide, covering: replies to inquiries about the REV M2, financing, or shipping; requested quotes and follow-up on an order or financing application; delivery and appointment scheduling or updates; and general customer care related to your inquiry or purchase.
Message frequency varies based on your interactions with us. Message and data rates may apply, as determined by your mobile carrier and plan. Consent to receive text messages is not a condition of any purchase or financing approval.
You may opt out at any time by replying STOP to any message; we will send a one-time confirmation and send no further messages unless you opt in again. You can get help at any time by replying HELP, or by contacting us at (855) 234-5551. Carriers, including AT&T, T-Mobile, and Verizon Wireless, are not liable for delayed or undelivered messages.
We do not sell, rent, or share your mobile phone number or your SMS opt-in consent with any third party or affiliate for their own marketing or promotional purposes, under any circumstances. Your mobile information is used solely to fulfill the purpose for which you provided it, as described in this Privacy Policy, and is shared only with the service providers described in Section 5 below where necessary to deliver the Program (for example, our SMS delivery platform).
5. How We Share Information
We do not sell your personal information. We may share information:
- With financing partners (such as Synchrony Financial or Dealer Direct), only when you choose to apply through a link to their portal;
- With service providers who perform functions on our behalf, such as website hosting, form processing, email/SMS delivery, and analytics, under obligations to protect your information;
- With shipping and logistics partners, to the extent needed to arrange delivery of a purchased vehicle;
- To comply with law, legal process, or governmental request, or to protect the rights, property, or safety of Flex Powersports, our customers, or others;
- In connection with a business transfer, such as a merger, acquisition, or sale of assets, subject to standard confidentiality arrangements.
6. Your Privacy Rights
Depending on where you live, you may have rights to know what personal information we collect about you, request a copy of it, request correction or deletion, and opt out of certain disclosures. Residents of California, and a growing number of other states with comprehensive privacy laws, may have specific statutory rights under laws such as the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). To exercise any of these rights, contact us using the information in Section 11 below; we will verify your request and respond within the time required by applicable law. We do not sell or "share" (as defined under the CCPA) personal information for cross-context behavioral advertising, so there is nothing to opt out of in that respect today.
7. Data Retention
We retain the personal information you submit for as long as reasonably necessary to respond to your inquiry, fulfill the purpose for which it was collected, and satisfy any legal, accounting, or reporting obligations, after which it is deleted or anonymized, unless you request earlier deletion and we are not otherwise required or permitted to retain it.
8. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect from unauthorized access, use, alteration, or disclosure. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
9. Children's Privacy
The Site is intended for a general audience and is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us so we can delete it.
